Additionally, the AKS broadly defines remuneration as anything of value, such as cash, gifts, discounts, the furnishing of supplies or equipment, credit arrangements, payments of cash, and more. Navigating the Physician Self-Referral Law (Stark Law) Healthcare Compliance

The Physician Self-Referral Law is a significant regulation in the healthcare compliance sector that prohibits physicians from referring patients to receive “designated health services” payable by Medicare or Medicaid from entities with which the physician has a financial relationship. Under the Stark Law, if a physician has a financial relationship with an entity, the law prohibits the physician for referring patients to the entity for designated health services that Medicare and Medicaid covers. As a result, this includes clinical laboratory services, among others commonly considered in healthcare compliance.

Thus, the law aims to ensure that medical decisions are made based on patient care needs and not influenced by the financial interests of the treating physician.
