Retaliation
Equal employment opportunity (EEO) laws protect employees from being punished for exercising their right to employment free of harassment and discrimination. Moreover, these strict laws prevent employers from retaliating against any employee that exercises their civil rights in a way against the wishes of that employer. Retaliation can take many forms by an employer as a response to an employee taking advantage of their EEO rights especially when filing a complaint.
Complaints do not always need to be filed by the individual themselves but can also be filed by others on their behalf. Additionally, It is important for employees to know the steps and the process surrounding filing this complaint in the event that it is necessary.
Filing a Complaint
Once you file a complaint with your Local or Lab Office of Civil Rights, the complainant is paired with a counselor. They serve as a neutral party in the dispute. Once at this stage mediation is an available option.
Alternatively, you may file a formal complaint following which an investigation will occur. After this, there is a hearing before a final decision is made on the case.
