A new report has come out with the rates of HIPAA noncompliance. The study from shows that 51% of providers are not completely in compliance with HIPAA’s Right of Access Law. Furthermore, Ciitizen conducted the study.

One of the key findings was that patient records were not being provided in a consistent manner. Also, patients were not receiving records in “the digital format of their choosing,” according to HIPAA Journal. Most of the time, the records need a “significant intervention.”

The study also found that patients had to make multiple calls before getting their records in the format they wanted. If it were not for the multiple calls placed by patients, there is a high probability the provider would not have been compliant.

Ciitizen also found that most patients were requesting records in one specific format. To become completely compliant, more digital formats should be used. Fax machines and CD drives on laptops can hinder the compliance process. In order to help it move more smoothly, requests of the patient records should “reflect real world scenarios,” according to HIPAA Journal.,

Lastly, the study found that more and more providers are accepting requests through these methods. Ideally, this would increase the compliance rate.
